Welcome to Noah Gabriel & Co. Jewelers. These Terms of Service ("Terms") govern your access to and use of our website, our online ring builder, our text messaging program, and any related services (collectively, the "Services"), as well as any purchases you make from us. By accessing our website, using our tools, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

In these Terms, "Noah Gabriel & Co. Jewelers," "we," "us," and "our" refer to Noah Gabriel & Co. Jewelers. "You" and "your" refer to you, the user or customer.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to make a purchase or enter into these Terms. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Use of the Website

You agree to use the website and Services only for lawful purposes. You may not use the Services in any way that could damage, disable, overburden, or impair our systems, or interfere with any other party's use of the Services. You may not attempt to gain unauthorized access to any portion of the website, other accounts, or any systems or networks connected to the website.

3. Products, Custom Designs & the Ring Builder

We offer fine jewelry, engagement rings, and custom design services, including an online ring builder that lets you create and save ring configurations. Configurations you create with the ring builder are estimates and design references; they do not constitute a completed order, a reserved item, or a guaranteed price until confirmed by us in writing or at the point of sale.

Because gemstones and precious metals are natural materials, slight variations in color, clarity, cut, weight, and finish are normal and expected. Product images are for illustration and may not reflect exact dimensions or appearance. We reserve the right to correct any errors, inaccuracies, or omissions in product descriptions, pricing, or availability, and to change or update information at any time without prior notice.

4. Pricing & Availability

All prices are shown in U.S. dollars and are subject to change without notice. Prices for precious metals and gemstones may fluctuate with market conditions. Availability of any product is not guaranteed and may change until an order is confirmed. In the event an item is listed at an incorrect price, we reserve the right to refuse or cancel any order placed for that item, whether or not the order has been confirmed.

5. Orders & Payment

When you place an order, you are making an offer to purchase. All orders are subject to our acceptance, and we may refuse or cancel an order for any reason, including suspected fraud, pricing errors, or unavailability. You agree to provide current, complete, and accurate purchase and account information for all purchases.

Custom and special-order items, including custom rings created through the ring builder, may require a deposit and are generally non-cancelable once production has begun. Any deposit, cancellation, or payment terms specific to a custom order will be communicated to you before work begins.

6. Appointments

7. Shipping & Delivery

We will make reasonable efforts to ship or make available orders within the timeframes communicated at the time of purchase. Delivery dates are estimates and are not guaranteed. Risk of loss and title for items pass to you upon our delivery to the carrier or upon in-store pickup.

If you submit designs, photos, reviews, ideas, or other content to us or through the Services, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with operating and promoting our business. You are responsible for ensuring you have the rights to any content you submit, and that it is not unlawful, infringing, or offensive.

11. Third-Party Links

The website may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party sites, and providing a link does not imply our endorsement.

12. Text Messaging Program

Our text messaging program terms are set out below and are incorporated into these Terms.

Program Name. Noah Gabriel & Co. Jewelers Text Messaging Program.

Program Description. When you opt in to receive text messages from Noah Gabriel & Co. Jewelers, you may receive SMS and MMS messages related to your ring design, saved configurations, appointment scheduling, order updates, and related communications from Noah Gabriel & Co. Jewelers. These messages are sent to help you stay connected with Noah Gabriel & Co. Jewelers regarding your jewelry inquiry.

Consent & Opt-In. By checking the SMS consent checkbox on the Noah Gabriel & Co. Jewelers ring builder and providing your phone number, you expressly consent to receive text messages from Noah Gabriel & Co. Jewelers at the phone number you provided. Consent is not a condition of purchase or use of the ring builder tool. You may use the ring builder without opting in to text messages.

Message Frequency. Message frequency varies depending on your interaction with Noah Gabriel & Co. Jewelers. Typical messages include appointment confirmations, follow-ups on saved ring designs, and responses to your inquiries. You will not receive more than 3 messages per month unless you initiate additional conversations.

Message & Data Rates. Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan. Noah Gabriel & Co. Jewelers is not responsible for any fees charged by your carrier.

Opt-Out. You can opt out of receiving text messages at any time by replying STOP to any message you receive from Noah Gabriel & Co. Jewelers. After sending STOP, you will receive a one-time confirmation message, and no further messages will be sent unless you opt in again. If you experience any issues opting out, contact us using the information below.

Help. For help or questions about the text messaging program, reply HELP to any message you receive, or contact us using the information in Section 16.

Supported Carriers. Messages are supported on all major US wireless carriers including AT&T, Verizon, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. 14. Disclaimers & Limitation of Liability

The Services and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, except as required by law or as expressly stated in a written warranty we provide. To the fullest extent permitted by law, Noah Gabriel & Co. Jewelers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services or any products purchased. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid for the product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Noah Gabriel & Co. Jewelers and its owners, employees, and affiliates from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania.

17. Changes to These Terms

We reserve the right to modify or discontinue the Services or these Terms at any time. In the event of any changes to these Terms, an updated version will be made available at this page with a revised effective date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
